Good question, if it is in the same country I would say on the seller. International orders, especially when customs are involved get too complicated to deal with
For me custom is a way to get something more unique as well, most of the time a colour / colour combination I can't get OTR. But yes, OTR can get you a lot of good things to start with :)

The key point is whether it is a flaw that was missed or something that is considered acceptable by the maker and sent anyway, or even worse sent while counting on the customer not to notice.

What I can say for sure, is that I have seen it misused to excuse flaws in handmade products.
It is a natural reaction.
For Japanese hand made products, people often use the term "wabi-sabi" to excuse flaws. Where the real thing is about showing the imperfection of nature, but "human touch", "wabi-sabi" and others are just excuses.
In this case, it is real wabi sabi.
