The Guggenheim embroglio over marital estate division and primacy of dower right in law
recalls to mind the case of the late singer Frankie Lymon whose Why Do Fools Fall in Love? signature
song heralded a fast flare felled star who tragically died from a heroin overdose circa 1964.

Three women came forward to claim his estate, substantial by normal run of the mill but rather
low ball by entertainment industry standard; all claimed marital status or common law equivalence.
A flick was made so I learned about this all after the fact, and one of gals, the legally married to,
caught my eye so I was dragged inside the story, which in law amounted to three cows sashaying
down the trail but only one of 'em wearing a bell. The learned judge decided all three partake equal
cuts of pie but in my opinion the judge committed what is known as 'judicial error.'
Such bench error constitutes appellate ground; however, an insufficient estate cumulative; other women
who might step forward and petition to join suit during appeal; garnish, estate, state of California censure;
and wear-and-tear property maintenance, all lumped together with attorney fees whittled it all down
to a pragmatic settle and saddle up scenario.

Guggenheim is quite different and I believe suit was filed in New York which favors Mom and the kid,
which with dower right-an established legal claim principle should seal verdict. And, of course, the estate
diminution fact-or-fiction begs resolve.

(National League rules in 1941 prohibit the lights from being turned on during a game that began in daylight. A stupid rule, in retrospect, and a frustrating one at the time. Especially, I would imagine, for Fitz.)...

Definitely a dumb rule, but seeing how we today struggle to make rules in real time that make sense around new technology, especially when a lot of competing interests are at stake and people's "old ways" of making money are adversely impacted, it's easy to understand how this silly lights rule came about.

I've noted it before, "Dan Dunn" is best understood as opera and "The Gumps" is best understood as Romanticism. Supporting that, the ghost story was a genre within Romantic literature or "Dark Romanticism." Even the illustrations in today's strip look like ones you'd see in those old Victorian Ghost Story books.

We are lucky as our building in on high ground. We purchased our apartment after Sandy flooded the city and purposely chose a building out of the flood prone areas. But as always, luck is part of it and we are grateful our building had no flooding.

The rain (over now) was crazy the past day - it just kept coming down. It would be hard for a flood-prone area - or subway - not to have issues.

Hopefully, it will have lost energy and moisture by the time it gets up to you. Good luck.

Three more of the 33 persons indicted as Nazi spies last July 12th pleaded guilty today when the case was called to trial in Brooklyn Federal Court, while indications are that the jury to hear the trial of the remaining suspects will be completed before tonight's adjournment. 51-year-old tool and die maker Paul Banie of Manhattan, 36-year-old restaurant operator Richard Eichenlaub of Yorkville, and 39-year-old soda dispenser Felix Jalmke of the Bronx, all German-born naturalized U. S. citizens, entered their guilty pleas before Justice Mortimer Byers today, and will join the fourteen suspects who have previously pleaded guilty in awaiting sentencing at the conclusion of the trial.

Army and local authorities on Long Island have launched investigations into the cause of yesterday's crash of an Army pursuit plane in East Hempstead, an accident that claimed the lives of three children. 8-year-old Pauline Cuccio, her brother 5 year old Jasper Cuccio, and their 3-year-old friend Georgine Kramer died last night at Meadowbrook Hospital as result of severe burns inflicted by the crash. While Nassau County Civilian Defense authorities are gathering information for presentation to Army Air Force investigators, the Army itself has remained silent on the extent of its probe of the crash. The three children were sprayed with burning gasoline when the P-40 airplane slammed into a vacant lot and exploded, with the impact wave shattering plate glass windows in nearby stores and sending flaming wreckage in all directions. The pilot, identified as 2nd Lt. Roy W. Scott of the 8th Pursuit Group stationed at Mitchel Field, had attempted to steer the falling plane away from the town before he bailed out at an altitude of 800 feet. The pilot landed in a tree about 500 feet from the crash site and was not seriously injured. Also declining to elaborate on the extent of his investigation is Nassau County Assistant District Attorney Edward J. Neary.

Officers from Mitchel Field raced to the scene of the crash yesterday to examine the smoking wreckage. One was reported to have declared "I've found it!" as he removed a small object from the wreck. It is believed that the plane may have carried secret equipment vital to National Defense.

Giant British bombers marked the second anniversary of the declaration of war against Germany by igniting great fires in the capital city of Berlin and over a vast area of Western Germany. Fires burned thru the night thruout Berlin's industrial sections, and also in the major industrial center of Frankfurt. Bombers returning to their British bases also rained explosives along the Boulogne-Calais sector of the invasion coast.

A Red Army counterattack by artillery, tank and infantry forces drove German invasion troops back three miles across the Neva River, as the battle for Leningrad continues to rage. Soviet air force planes beat off mass assaults by German raiders, while behind the German lines, bands of Soviet guerillas cut Nazi communication lines and made surprise attacks on small garrisons.

A "belligerent blonde" who fought back when she was placed under arrest by a detective Saturday night continued the battle today in Flatbush Court. The woman, who gave her name as Jane Brooks of 320 Flatbush Avenue, aimed a roundhouse right at a newspaper photographer who attempted to snap her picture as she was led before Magistrate Nicholas Pinto this morning, but her blow missed its target. Miss Brooks, whose name police believe to be fictitious, was taken into custody on a disorderly conduct charge Saturday by Detective Hyman Gillary, who confronted her as she engaged in a vigorous argument with a group of men at the corner of St. Marks Place and 6th Avenue. Miss Brooks kicked Detective Gillary in the shins and when several patrolmen appeared on the scene to assist in the arrest, she attempted to do likewise to them. Magistrate Pinto ordered the case sent to Special Sessions Court, and as Miss Brooks was led out she again made an attempt to confront newspapermen waiting outside, but was this time restrained by a patrolman.

Cobina Wright Jr. will not marry a $54-a-month Army Air Corps corporal who had chartered a plane in hopes of courting the heiress-actress and who had prematurely, it turns out, announced their engagement. Corporal Palmer T. Beaudette, on leave from his base at Ft. Lewis, Washington, paid $1300 to charter an airliner to Reno, where Miss Wright and her mother have been summering, but Cobina Wright Sr. issued a statement today declaring that "while Beaudette is a nice chap, Cobina is not engaged to anyone. She is more interested in her career. I think all the excitement was caused by a corporal being seen on a plane by himself." Beaudette, an Army selectee and the son of a retired auto-body manufacturer, told reporters "it was worth every cent."

Representatives of more than 100,000 gasoline retailers in 17 states along the Eastern Seaboard will meet today in Philadelphia to consider a ten-point statement on the present fuel situation in the region. A spokesman for the Associated Gasoline Dealers of Philadelphia declared before the meeting convened that he will present proof that no actual shortage of gasoline exists.

It fizzled here -- we had some rain yesterday morning, but other than blowing a couple more shingles off my roof, impact was minimal. We've been lucky so far this year, but the season is still young.

The return of Senga would be the comic strip event of the season. Maybe Harold would even get his $250 back.

It's going to be excruciating to see just how far Mr. Gould takes the decomposition of Little Face, but I imagine, given his dedication to his own peculiar form of art, that he won't disappoint us.

I want to know exactly what kind of top secret device would be on board a pursuit plane in 1941. Certainly not a bombsight, but maybe some kind of experimental radar gadget?

This story reminds me a lot of an incident that happened in my home town in 1947 -- an Army plane from Dow Field in Bangor went out of control and the pilot managed to bring it down in the river that runs just past the downtown business district. My mother was among the kids who were out in the streets and saw the plane go down, one of my aunts was among the rescue party, and my great-grandfather was in control of the fire department at the scene. The pilot was mangled beyond saving, but in managing to bring the plane down where he did he saved dozens of lives.

Agree that there would not be a bombsight or radar or anything "top-secret" on a P-40 - a very ordinary fighter/pursuit plane. Sounds like the news person was trying to boost the story...
As for the "Yoo-Hoo" incident - what got the soldiers in trouble was that what they were yelling at the girls on the golf course was definitely not "Yoo-Hoo".
Gen. Lear, who was there and heard it himself, never told the press exactly what they did say. The punishment of a fifteen-mile march wasn't something that went on their records, but was just enough to get their attention.
It was the press who blew the incident out of proportion.

The Senate voted today to lower personal income tax exemptions to $750 for a single person and $1500 for married couples. The adjustment is part of a $3,679,800,000 revenue bill now under consideration, and was passed by a vote of 43-23 on a recommendation from the Senate Finance Committee. The adjustment faced objections from Sen. Robert A. Lafollette (P-Wisconsin) who argued that the measure would penalize families whose income and living standards are already inadequate according to Government statistics.

Prime Minister Winston Churchill today called for "full American co-operation in every field" in support of Britain's war effort, as a Canadian suggestion was advanced that the United States should guarantee formally that it "stands at Britain's side against Germany as Britain stands with the United States in the Far East." The remarks by Mr. Churchill and Canadian Prime Minister William Mackenzie King coincided with a British invitation to members of Congress to visit Britain and see for themselves the use to which American war materials are being put.

The State Department was advised today that the first American tanker bearing a cargo of gasoline arrived today at the Soviet Pacific port of Vladivostok. The tanker L. P. St. Clair of the Union Oil Company had sailed from Los Angeles on August 15th and docked on Wednesday. Its route carried the ship thru the narrow straits between the northern islands of Japan, but while the Japanese Government has indicated its "unwillingness to acquiesce" to the shipment of supplies to an enemy of its ally Germany, there was no indication of effort by Japan to interfere with the tanker. The ship is the first of a group of American vessels assigned to carry gasoline to Russia.

A series of successful Red Army offensives are reported to be cutting deeper into Nazi lines, forcing the enemy "to abandon one position after another." Moscow newspapers reported that one counterblow was struck in the northwest sector near Leningrad, while another was reported near Kiev, in the Ukraine, where 15,000 Nazi troops were reported killed or wounded.

Stating that Democrats "have either seen the light or are making a last desperate attempt to confuse the voters," Mayor LaGuardia today signed Democratic-sponsored bills abolishing the county offices of sheriff and register in New York City, and providing for the election of a single city-wide sheriff. The Mayor ignored protests from the Citizens' Union and the National Lawyers' Guild in approving the measures, but bluntly warned that he is ready to stump for the "superior Fusion reform program" in the upcoming election if the Democratic reforms are not pressed to a successful conclusion. "I am dumping this baby of doubtful parentage in their laps," said the Mayor, "and they will have to nurse it to a healthy maturity." Brooklyn Democrat Joseph T. Sharkey, vice-chairman of the City Council, pledged his support for the reforms, stating that "they were drawn up in all sincerity."

The Eagle Editorialist salutes Mr. Larry MacPhail for abandoning any notion of the Dodgers playing any of its World Series home games anywhere but in Brooklyn. "Compared with Yankee Stadium, which seats 75,000, Ebbets Field's capacity of 35,000 might seem awfully small," he notes, "but it is a fact which must not be forgotten that our local park is as large as 13 out of the 17 parks in which the Series has been played." The EE reiterates that it would be an insult to Brooklyn to play these games anywhere but Ebbets Field, and again points out that it is the support of local fans that has made the success of the ball club possible.

The Football Giants beat the Eastern Collegiate All Stars 23-7 before 54,279 at the Polo Grounds yesterday, in the traditional start to the metropolitan grid season. Attendance was the largest in the history of the game, an annual benefit for the Herald-Tribune Fresh Air Fund.

...The Eagle Editorialist salutes Mr. Larry MacPhail for abandoning any notion of the Dodgers playing any of its World Series home games anywhere but in Brooklyn. "Compared with Yankee Stadium, which seats 75,000, Ebbets Field's capacity of 35,000 might seem awfully small," he notes, "but it is a fact which must not be forgotten that our local park is as large as 13 out of the 17 parks in which the Series has been played." The EE reiterates that it would be an insult to Brooklyn to play these games anywhere but Ebbets Field, and again points out that it is the support of local fans that has made the success of the ball club possible....

It's been fun watching MacPhail backpedal on this extremely stupid and greedy idea almost from the moment he put up a trial balloon.

President Roosevelt today declared his belief that a submarine attack on the destroyer U. S. S. Greer yesterday on the American side of the North Atlantic was "deliberate," and revealed that U. S. naval forces are presently attempting to locate and destroy the vessel responsible for that attack. The President stated that the Greer, making for Iceland in daylight, was clearly marked to indicate its nationality, and was fired upon by the submarine "more than once." The Greer responded to the attacks by dropping depth charges, and the President reported that other Navy ships have joined the search for the sub. Asked whether the incident represents the beginning of an undeclared war in the high seas between the United States and Germany, the President was noncommittal, noting that he had said nothing about the possible nationality of the attacking submarine, and dismissing the general question as "hypothetical."

A 25-year-old Ridgewood woman active in German-American Bund circles was arrested today by the FBI as a co-conspirator with the "Maspeth Mata Hari." Authorities say Mrs. Helen Pauline Mayer has been indicted in Manhattan Federal Court as a cohort of 18-year-old Lucy Boehmer of Maspeth, previously charged with sending National Defense secrets to Germany. Mrs. Mayer's husband, Walter Kurt Mayer, employed by a manufacturer of pinking shears, is a German national who attempted to return to Germany in early June, but was stranded in Japan by the outbreak of the Russo-German War. Mrs. Mayer was born in Brooklyn, and is employed as a secretary with the Geigy Company, chemical concern, in Manhattan. She is reported to be a member of the Yorkville branch of the New York Turn Verein, a "gymnastics club." Mrs. Mayer is being held on $10,000 bail pending trial.

Meanwhile, Karl Boehmler, father of "the Maspeth Mata Hari,' was reportedly fired yesterday from his job of 21 years as a washer with the Octagon Laundry in Ridgewood. Said the proprietor of that laundry, "we are strictly an American plant, and we will not countenance such things," adding that he doesn't want anyone working at his laundry who is connected to spying activities.

U. S. Attorney General Francis Biddle today revealed that four corporations and two individuals in Manhattan have pleaded nolo contendere to civil charges of maintaining illegal connections to German firms and have agreed to a consent decree terminating those affiliations. The Alba Pharmaceutical Company, the Bayer Company, the Winthrop Chemical Company, and Sterling Products Corporation, along with two officers of the Sterling firm, were determined to be in violation of federal antitrust laws by agreements with I. G. Farben Industrie of Germany restricting American exports to Latin America. The Attorney General emphasized that Sterling Products is wholly an American owned firm with no direct ties to foreign interests.

A grandiose scheme to establish a commercial laboratory using equipment and supplies stolen from Brooklyn Technical High School came to light today with the arraignment of a 19-year-old honors graduate of that school on theft charges. Israel Weingarten of 121 Tapscott Street appeared in Brooklyn Felony Court today accused of stealing $2000 worth of apparatus from the school after he was caught in the act by a school custodian last Sunday morning. One other June graduate and a current Brooklyn Tech student are also said to be involved in the scheme. All three youths are free on bail pending grand jury action.

The chairman of an American Labor Party faction that published an advertising poster showing a worker about to kill a snake decorated with swastikas and the names of Charles Lindbergh, Burton K. Wheeler, and Herbert Hoover is defending that poster from criticism leveled by the local chairman of the America First Committee. The head of the Progressive Committee to Rebuild the A. L. P. declared today that the record proves that there is "justification for the poster" based on statements made by the persons named on the snake's body. "It is the America First Committee and the Hoovers, Wheelers, and Lindberghs who tell us Hitler means no harm," said Chairman Arthur E. Blyn. "We have heard that song and dance before. Quisling, Laval, Petain, Darlan, and the rest of the European counterparts of the America First Committee also preached such a doctrine in their nations. The results are plain for the world to see." Meanwhile, the rally advertised by the poster at the Coney Island Velodrome was rained out last night, and has been rescheduled for next Thursday at the same location.

With the sale of the new Dodger book now exceeding 50,000 copies at 25 cents each, officials of the H. W. Publishing Company observe with interest that about three percent of mail order sales for the publication are coming from St. Louis. Testifying to the national interest in Brooklyn's ball club, the publishers say orders for the book have been received so far from 32 of the 48 states, and also from Ontario and Quebec.

Meanwhile, the Dodger Victory Committee's final road trip of the season will take a Brooklyn delegation to Philadelphia on Sunday September 21st. Dodger fans will invade Shibe Park for a mass rally at the doubleheader that may play a key role in deciding the National League pennant. Buses will leave Borough Hall at 9 am on the 21st, and will return to Brooklyn immediately after the conclusion of the second game. Tickets for the trip are available at the Dodger offices at 215 Montague Street, or directly from the Victory Committee at 193 Joralemon Street.

McCrea is reported to be a current favorite of Mr. Sturges on the strength of his performance opposite Veronica Lake in the soon-to-be-released "Sullivan's Travels." Miss Colbert has just completed a role opposite Ray Milland in "Skylark."

I agree. Usually, I'm against a 2021-style answer, but these two should just go into the broom closet, have at it, then come out and work better together. I think they have real feeling for each other, but even if the closet romp is just hate sex, they need to defuse the tension in their relationship for the good of the paper.

I am not conversant with the facts in Hanassen-low print-but the article seemed sufficiently singular
to be classed 'Landmark' as to adjudication. The learned judge I believe erred; presumably defense
made motion for a directed verdict or the case was taken by the judge himself after trial. This calls
to mind a more recent case: Commonwealth of Massachusetts v Woodward in which a British nanny
violently shook an infant and subsequently stood trial and was convicted of infanticide; only to have
errant judgement nullify verdict and issue defendant reprieve without appropriate legal-or moral grounds.

Finnish dispatches from the front today claimed that Leningrad was "a scene of great confusion" and that flames could be seen rising from the city, from buildings destroyed by long-range German artillery. A report broadcast by Radio Helsinki asserted that the second-largest Soviet city has been "completely encircled and isolated," with airplane bombs destroying the only road left open to the north and residents of the Leningrad suburbs ordered to evacuate into the city proper. A further report from Helsinki claimed that Finnish troops now hold the entire Karelian Isthmus up to the old Russo-Finnish frontier and that all isolated groups of Russians have been "liquidated."

Units of the Atlantic fleet are presumed today to be searching by sea and air for the submarine which attacked the U. S. destroyer Greer on Thursday, under official orders to "eliminate" that unidentified submersible. An order by President Roosevelt that the submarine be destroyed was seen as indication that depth charges dropped by the Greer had failed to find their mark, and that the marauding vessel is still at large. Meanwhile, it was reported that the Greer has arrived safely in port at Reykjavik, Iceland, carrying a cargo of mail for U. S. forces stationed there.

In a moving letter to Mrs. Eleanor Roosevelt, the mother of one of the three children burned to death in the crash of an Army plane at East Hempstead, Long Island on Tuesday pleaded with the First Lady to help in efforts to prevent future accidents caused by low-flying military planes. The letter from Mrs. I. Arthur Kramer, mother of 3-year-old Georgene Kramer, was made public after the Army acknowledged that a similar smashup was narrowly avoided yesterday near Mitchel Gardens, which houses non-commissioned officers based at Mitchel Field and their families. A plane piloted by Lt. Everett Hubbard of the 33rd Pursuit Group made a forced landing in a clearing about 25 feet off Stewart Avenue, and just 75 feet south from occupied houses. The plane was wrecked, but the pilot was uninjured, and the Army has released no information on the cause of the crash.

The letter from Mrs. Kramer graphically described the death of her daughter, and her grief and rage at the Army for presenting her with a document to sign absolving the Army for liability for any property damage from the accident. She noted that her anger was compounded by the sight of Army planes flying over the gravesite as she buried her child, and observed bitterly that "not one word of condolence, not even a flower" was offered by military authorities for the death of her daughter. "I could have torn them apart with my burnt, throbbing fingers," she wrote, "but I could not desecrate my child's grave with evil, futile gestures." Mrs. Kramer beseeched Mrs. Roosvelt to do all within her power to keep training flights away from areas where children are present, and to ensure that the pilots in those airplanes receive adequate training before they fly.

A report released today by the Army states that the pilot involved in the Tuesday crash, Lt. Roy W. Scott of the 8th Pursuit Group, was not a trainee or a cadet, but an experienced pilot who became disoriented when the plane's cockpit filled with smoke, and though he was unable to see he clung to the plane as long as possible in an effort to bring it to a landing at the field. Scott bailed out of the plane at too low an altitude, and his parachute barely had time to open before he landed in a tree.

District Attorney William O'Dwyer stated today that he will not take action on a number of complaints filed with his office concerning solicitors, witnesses, and notarizers of signatures on petitions to place the name of Democratic Borough President John Cashmore on the Republican Party primary ballot for that office until after lawsuits filed over those petitions by county GOP leaders have been resolved. Mr. O'Dwyer, who is the Democratic Party's candidate for Mayor in the coming election, did not rule out future action depending on the outcome of the case now being heard by Justice Edwin L. Garvin in Brooklyn Supreme Court. Concluding arguments in the case are expected today, with a decision to be announced in time for it to be taken up in Appellate Court on Monday.

The Board of Education held a special executive session last night in Rockville Center to consider a strike by 73 "Negro students" who have been kept out of school since Wednesday by their parents in a protest over inadequate teaching and supervision. The pupils comprise about two-thirds of the students attending the Clinton Avenue School. Superintendant Floyd Watson indicated that there will be "a reallocation of Negro students" from kindergarten thru the seventh grade" which should "aid in clearing up" some of the protests made by the parents, and he ordered the striking students to return to class on Monday.

Terrified after she hit her husband on the head with a bottle during a family quarrel, a Brighton Beach woman died early this morning after drinking disinfectant. Forty-six-year-old Mrs. Ray Seiderman died at 3:25 AM at Coney Island Hospital, after police responding to a complaint from her husband found her unconsicous on a bed in the couple's apartment, a half-empty disinfectant bottle at her side. According to 46-year-old Meyer Seiderman, his wife had struck him on the head with a soda bottle around 2 AM, and he ran bleeding out of the apartment to seek help. Two patrolmen summoned an ambulance and accompanied Mr. Seiderman to the hospital to take his statement, but when they returned to the apartment they found the door locked. Breaking in the door, they discovered Mrs. Seiderman inside.

An announcement now being broadcast over WCBW, television station of the Columbia Broadcasting System, declares that "the programs of this station are intended primarily for home reception and other use may not be made of them without the permission of CBS." The announcement is believed to be an attempt to discourage the use of television as a means of attracting crowds to bars.

It's not a male or female thing, but in many marriages one spouse dominates and things work better when everyone figures that out. Joe has yet to fully figure out that, in most cases, agreeing with Sally is the way to make their marriage work. It's not a matter of right or wrong, it just is. If Joe wants to stay in the marriage and not fight all the time, he'll just have to be the one to give on a lot of the issues.

(Hollywood never really figured out how to present big bands to their best advantage -- with only a few exceptions, the music ends up taking second place to dopey plots and annoying guest stars. But if your guest stars are Sonja Henie, Milton Berle, and the Nicholas Brothers, I suppose it could work...)...

Agreed, but of that lot at that time, "Sun Valley Serenade" is the best by far as it does a pretty good job of integrating Glen Miller's band with the story. It's all fluff, but it's also the most entertaining of that era's ski / skating movies.

Finally, a picture, and I agree, a bit disappointing. Of course, in my mind, being a "feminine lure," I had built her up to a cross between Marlene Dietrich and Eva Braun, so disappointment was all but guaranteed.
