I'm a Parole Agent for the State of Illinois and so am familiar with the laws here on LEO use of force. It used to be called the +1 principle, and basically means that you respond with appropriate and measured tactics. Whenever someone is using a firearm, that is considered deadly force.
Let's look at what we do know. Police were responding to the report of people shooting handguns and rifles, and showed up to find a man with a high powered rifle capable of defeating their body armor at the scene. This rifle will easily shoot through several walls of residences in the area and heavy appliances, this means the citizens are in serious danger. Retreat as an option just went out the window. New Year's Eve means a higher than average possibility he is under the influence of some substance and he is wearing a uniform that would identify him as a member of a neo-nazi group. These groups have an active hatred of police and advocate violence against them. When he is ordered to drop his gun, he does not. He then raises it towards the officers.
This is a tragedy for both sides.
