The problem of Ebay (and some other sites) is that they do no really care unless somebody complains. In order to protect your own copyright or IP, you need to be proactive. That is why big companies have large IP/Legal depts to actively search for possible infringements.

Fully agree, hence all the " victims " should put their heads together and get it done.

This must be a fair sized business.

On some of their jackets, they offer a choice of over 50 colors!
At least thats what they advertise...please read the feedback...a lot of complains saying not as advertised, not as per the photos...etc...maybe also related to the vast choice of colors.
Maybe even a non registered business ( also in India a business needs to be registered...at least thats what it says officially...)... Maybe even child labor etc...

I read the recent positive feedback string and noticed in each case that when I clicked to see the item, the message was 'the sale had been ended early because the item is no longer available'. I find this odd as the usual message is 'you missed out on this item'. Has the seller found a way to boost his positive feedback to push negative feedback 'off the page', or were they genuine and they are no longer available because his stock has run out. As eBay has anonymised buyers identities in feedback lists it's impossible to 'drill down'.
There are ways to fool potential buyers into believing a seller is reputable, for example, a few years ago I found a Chinese seller with a high positive feedback but when you checked the items purchased they were tiny items sold for a few pennies to Chinese buyers who were no longer ebay members - an obvious fraud- of course you could see their identities in those days and nowadays they are anonymous thanks to ebay changing their system.

To be fair, it's also the way the law is structured. In the EU (Ecommerce Directive, Section 4, Article 14), and in the US for copyright infringment only (Digital Millenuim Copyright Act, S512), were ebay to go proactively looking for infringing content on their servers, they'd be considered to be asserting editorial control over the content therein and thus would become directly liable for the infringements. If, however, they are merely hosting the content without editing it, as long as they have a clear notice and take down and respond with reasonable haste to any complaint, they will not be liable.

While I'm not always best impressed with eBay (they don't seem to do as much as they could - for instance, a repeat offender at this sort of thing should be kicked off eBay with the same alacrity as a repeat non-paying bidder, imo), I don't blame them for playing the law this way.

I am certain that if all of us at TFL, report the counterfeit to Ebay, Ebay will do something about it, this would be the first step.
GW, Aero, ELC, HPA, NH , BR etc need to involve their legal depts into the play.

We're on this, but Ebay and the process is slow. If anyone or group wants to continue to pile on Ebay, it couldn't hurt. Thank you!

In theory yes, if they fail to remove specific infringements of which they have been notified, then they would become liable for those specific infringements. Acase would still have to be brought by the rightsholders though (expensive and time consuming). The law is much more of a grey area when it comes to dealing with an individual who has repeatedly put up infringing material, and the extent to which a company is obliged to keep an eye on them. Any decent system like eBay really should have internal bans leading to the suspension or expulsion of repeat offenders at this sort of thin,g but ranged up against the profit motive....

The thought of what a customer would actually receive is kind of frightening!

Had a friend ordering a so called Lewis Leathers Easy Rider jacket years ago and what he received was a "glove leather" version of kind of dark brownish jacket with painted stripes.
He got caught in heavy rain and the paint on those stripes started to wash away and his jacket turn full brown.
By the first weeks the zippers where also ruined.
It's like burning dollar/euro/pound bills.
