Copyright and 'sampling' has always been an issue.

Here's Glenn Miller's enormously successful (but patently 'borrowed') "In the Mood." Below that, one-armed Wingy Manone's "Tar Paper Stomp," which predates Miller's recording by 10 years.

Wingy was eventually paid-off to stop him contesting copyright.
